Managers and HR personnel could now be personally liable, along with company directors, for breaches of federal workplace laws by their employer.

As reported in the Australian Financial Review, earlier this week Fair Work Ombudsman Natalie James told a gathering of HR managers that anyone involved in decision-making around the strategy for and compliance with workplace laws should consider themselves “on notice”.

In a warning to managers, supervisors, HR advisers and recruiters, as well as other entities in a supply chain, James said: “You can find yourselves personally liable for the actions or inactions you help the company take…Just like employers, we expect advisers to take their responsibilities clearly.” .
